These Terms govern your use of the website and general access. Use of the Sharaftona loyalty platform (“Platform” or “Services”) is subject to our subscription plans displayed on: https://sharaftona.com/ By subscribing, you enter into a binding SaaS agreement with Sharaftona. We provide a self-serve SaaS model, and you may create an account, start a 14-day free trial, and upgrade to paid plans directly through the Site.
We may offer a 14-day free trial. We reserve the right to: • Limit trial features • Restrict access after trial ends • Prevent abuse (multiple trials) We are not obligated to provide data export after trial expiry.
Refunds are provided case-by-case only, at Sharaftona’s sole discretion. Factors may include: • Technical issues • Billing errors • Exceptional circumstances There is no automatic right to refund.
All content on the Site, including text, software, UI, graphics, logos, videos, designs, and documentation (“Sharaftona Content”) is owned by or licensed to Sharaftona. You are granted a limited, non-exclusive, non-transferable license to use the Site for business purposes. You may not: • Copy or resell the platform • Reverse engineer • Create derivative products • Scrape or extract data
You may upload content including: • Logos • Text • Images • Customer data You retain ownership of your content. By uploading, you grant Sharaftona a worldwide license to host, process, display, and use the content solely to operate the Services. You are responsible for ensuring you have the legal right to upload and process such data.
All trademarks, logos, and service marks are property of Sharaftona or third parties. You may not use them without written permission.
The Platform may integrate with third-party services including: • Payment processors • Email services • Wallet platforms • Cloud infrastructure Sharaftona is not responsible for third-party systems, downtime, or policies. Use of third-party services is at your own risk.
Use of the Services is governed by our Privacy Policy available at: https://sharaftona.com/privacy For merchants: Sharaftona acts as Data Controller For loyalty members: Sharaftona acts as Data Processor
You agree not to: • Use the platform illegally • Upload unlawful content • Abuse system resources • Attempt unauthorized access • Use the platform for spam or fraud Violation may result in immediate suspension or termination.
The Services are provided on a best-effort basis. We do not guarantee: • 100% uptime • Error-free operation • Continuous availability We may perform: • Maintenance • Updates • Beta testing Which may result in downtime.
You agree to comply with all applicable laws, including: • Data protection laws • Anti-fraud laws • Anti-bribery laws • Export control laws You confirm you are not subject to sanctions.
You agree to indemnify and hold harmless Sharaftona from any claims arising from: • Your use of the Services • Your uploaded content • Your violation of laws • Your customers’ data
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL WARRANTIES INCLUDING: • MERCHANTABILITY • FITNESS FOR PURPOSE • NON-INFRINGEMENT • DATA ACCURACY
TO THE MAXIMUM EXTENT PERMITTED BY LAW: Sharaftona’s total liability shall not exceed USD 100. We are not liable for: • Loss of profits • Business interruption • Data loss • Indirect or consequential damages This applies even if we were advised of the possibility.
You are responsible for: • All activity under your account • Protecting login credentials • Actions of your employees or agents
We may suspend or terminate your account: • For breach of these Terms • For illegal use • For security risks • Without notice if required by law You may cancel anytime through your account.
You consent to receive communications electronically, including: • Emails • Platform notifications • Legal notices
We may update these Terms at any time. Continued use means acceptance of the latest version.
These Terms are governed by the laws of the United Arab Emirates. All disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
These Terms constitute the entire agreement. If any provision is invalid, the rest remains effective. Sharaftona may assign these Terms freely. You may not assign without written consent.
